Dispute Resolution Mechanisms

 Module Description This Module will explore the various tools and avenues available to address conflicts which may arise between the Commissioner General and relevant parties, be it a taxpayer or another competent authority.
 Objectives At the end of this Module, the participants should be able to:
Knowledge  Discuss the types of disputes that may arise  Examine measures of avoiding tax disputes  Define dispute resolution  Discuss the different types of dispute resolution  Explore the Legislative Framework for disputes and objections  Discuss the structure and role of the Technical Advisory and Tax Dispute Resolution Division  Discuss the structure and role of the Revenue Appeals Division  Discuss the role of the Supreme Court (Revenue Court), Court of Appeal and the Privy Council  Examine the Mutual Agreement Procedures (M.A.P.)  Discuss arbitration  Discuss the challenges faced by developing countries in resolving tax disputes 
Legal and Technical Framework of Jamaica Customs
Duration: 30 Hours
Course Description This course provides an overview of the role and functions of the Jamaica Customs Agency. This includes, the various international treaties and agreements which governs the import and export of goods., There will also be consideration to the different duties, taxes and exemptions imposed at the ports. Participants will be able to apply the different incentive regimes and develop an appreciation of the importance of the Automated System for Customs Data (ASYCUDA).
 General Objectives
At the end of this course, participants should be able to:  Gain an understanding of the legal framework of Jamaica Customs and the role of the Jamaica Customs Agency within the structure of the Government of Jamaica  Visit selected customs locations to observe activities in various functional areas  Develop an understanding of legal and technical competencies relating to post clearance audit and the use of relevant software application
